SUBJECT:
Approval of an extension for the Planned Development (PD) Approval for the project commonly known as Villages at Midway, located on northside of Midway Road and west of I-95. This project was originally approved on April 4, 2016 via Ordinance No. 16-009. The new date for the site plan expiration would become June 3, 2021.
SUMMARY:
- The Applicant's Representative, W. Lee Dobbins of Dean, Mead, Minton & Zwemer Law Firm is requesting an extension based upon four of the Governor's Executive Orders. Executive Orders address declared disasters by giving applicants additional extensions of time for applicants who request the extension.
- Florida Statute 252.363 sets forth the extension of expiration date for emergency orders.
- The Applicant's Representative previously requested an extension for Executive Orders 17-174, 17-204 and 17-235 signed by Governor Rick Scott.
- The Applican'ts first extension was granted until April 7, 2020 for the three Executive Orders by Governor Rick Scott.
- The Applicant's Representative is requesting an additional extension for Executive Orders 19-189, 19-234, 19-281 and 20-43 signed by Governor Ron DeSantis.
- When separate emergency events triggering the extension overlap, the period of the overlap is counted once and not added together.
- This project was initially approved on April 4, 2016 with a two year approval to commence, this approval would have expired on April 4, 2018. However, the Governor Rick Scott's Executive Orders extended the expiration to April 7, 2020.
- The Applicant's Representative is now requesting an additional extension due to Governor Ron DeSantis' Executive Orders with an extended expiration date of June 3, 2021.
RECOMMENDATION:
Approve the extensions based on the State of Florida Executive Orders issued by Governor Ron DeSantis.
ALTERNATIVES:
Staff will proceed as directed by the City Commission.

OTHER INFORMATION:
This is one of the largest undeveloped projects in Fort Pierce, extending the site plan assists in its future development.
