Text Amendment - Chapter 125-187 & 125-318 - Allowed Uses/Home Occupation

SUBJECT:

Legislative Hearing - Ordinance 20-009  changing the home occupation use in the Central Commercial (C-4) zoning district from a prohibited use to a conditional use; permitting mixed uses to be constructed as individual buildings or developments in the Central Commercial (C-4) zoning district, both vertically and horizontally; changing duplex, detached house, and townhouse uses in the Central Commercial (C-4) zoning district from prohibited uses to conditional uses; defining the utilization of home occupations located on parcels within the central business district (CBD) Future Land Use designation. SECOND READING

SUMMARY:

  • The City is proposing a Zoning Text Amendment to Article III – Basic Zoning Districts, Section 22-22, Allowed Uses, of the City of Fort Pierce Code of Ordinances to encompass the Central Commercial District (C-4) and is proposing that Detached Houses, Duplexes, & Townhouses be permitted as a Conditional Use to facilitate the current trend in downtown living in order to make way for future mixed use developments.
  • The Amendment to City Code 22-22 also seeks to strike the word “vertical” from the mixed-use building category to allow for a mix of uses within the same structure, regardless of its location in that structure. This deletion will also identify and define mixed use development within the Use Table.
  • The proposed Text Amendment also seeks to change the Home Occupation use in the Central Commercial (C-4) Zoning District from an expressly prohibited use to one where the use may be allowed, subject to Conditional Use approval from the City Commission. Currently, there are residences within the District which are not allowed to have home occupations. This Amendment would allow residences to have a home occupation in a similar manner as other residences in other zoning districts.
  • The third component to this proposed Text Amendment is to Section 22-63, Home Occupation, and is directly related to the changes recommended above. The Amendment to this Section seeks to further define the utilization of home occupations located on parcels with a Central Business District (CBD) Future Land Use designation by limiting their ability to be recognized as a mixed-use component of an overall development.
  • The City’s Comprehensive Plan mandates that properties in the CBD have certain mixed-use requirements as part of their development program. The proposed Text Amendment looks to allow for home occupations, while still maintaining the integrity and overreaching goals of the CBD.
