SUBJECT:

Quasi-Judicial Hearing and Resolution 24-R29 on notice of appeal filed by the City of Fort Pierce to appeal a decision made by the Historic Preservation Board on March 25, 2024, pursuant to Fort Pierce Code of Ordinance, Sec. 111-53, approving an application for conditional use for an expansion of outdoor entertainment area at 411 N 2nd Street..

SUMMARY:

REQUEST:  CONDITIONAL USE APPROVAL TO DEVIATE FROM CITY CODE SECTION 125-197, WHICH ALLOWS A MAXIMUM 800 SQUARE FEET FOR OUTDOOR ENTERTAINMENT SPACE.
LOCATION:  411 N 2nd Street. Parcel ID#: 2403-705-0119-000-4.
OWNER:  JON NOLLI, PIERCED CIDERWORKS.
 
The Historic Preservation Board approved the request with the following conditions:
  1. The total area used for outdoor entertainment at the property subject of the variance/conditional use be limited to a maximum of 5,000 square feet.
  2. The Conditional Use will run with the property following all provisions of Article II - Noise, of the City Code of Ordinances.
 
Grounds for the Appeal
The City of Fort Pierce requests that the City Commission review the decision to allow the increase in area utilized as outdoor entertainment space based on the impact generated by the expansion of the outdoor entertainment space on the health and welfare on immediate neighbors of the subject property. The City of Fort Pierce seeks relief from the anticipated additional noise, activity and disturbance resulting from the expansion of the area available for outdoor entertainment.
