Resolution 24-R37 authorizing the execution of a Reconstruction Agreement with All Digital All Day, LLC to remove the existing sign at 7049 Okeechobee Road, Fort Pierce, FL 34945 and construct a replacement sign pursuant to Florida Statutes.

All Digital All Day, LLC ("ADAD") currently operates a legally existing, conforming sign located at 7049 Okeechobee Road that they wish to remove and reconstruct with a replacement sign that meets engineering and wind load requirements. Section 70.20 of the Florida Statutes authorizes and encourages agreements of this type by empowering municipalities and owners of billboard signs to enter into reconstruction agreements, on mutually agreeable terms, that allow the municipality to accomplish its public goals while allowing the continued maintenance of private investment in outdoor advertising signs as a medium of commercial and non-commercial communication. 

As per the Agreement, ADAD will make the replacement sign available for the dissemination of public service information like public service announcements, promotion of City-sponsored events, and emergency notifications at no cost to the City. In addition, ADAD shall pay the City an annual contribution payment of $10,000 per digital sign face of the replacement sign for so long as the sign remains installed and operational.
