SUBJECT:

Quasi-Judicial Hearing - Review and approval of an application for a Conditional Use, with No New Construction by Atlantic Coast Recycling, located at 3301 Avenue D, more specifically located at Parcel Control Number: 2408-214-0001-000-2.

SUMMARY:

Application (PZCON2024-00003)
Atlantic Coast Recycling property owners have been advised that a Conditional Use review (CU without improvements) is required in order to regularize the recycling use. In effect, the existing use of the property remains the same as it has been for the last 20, or so, years.
 
The property was annexed into the City circa 2007, with a recycling use in place. The issue now being that the annexation did not include wording that the recycling use was to be permitted as a conditional use - which the zoning requires. Thereafter, building permits were issued for the installation of a compactor and a material transfer building that allowed this site to operate as an enhanced transfer station where the public could bring their recyclable metal materials. Atlantic Coast bales up the loose metals and thereafter have the bales transported to a reprocessing center in Central Florida.

RECOMMENDATION:

Staff recommend that the City Commission APPROVE the application for Conditional Use with no new construction.
