RECOMMENDATION:
The city requests that if the Special Magistrate finds the violation exists, the following be ordered:
- Per State Statute 162.09(2)(a), the violation is determined to be irreparable or irreversible in nature.
- Given the size of the protected tree (33.91 DBH), staff recommends imposing the maximum penalty of $5,000.00, to be paid within 90 days to the City's tree fund.
