BACKGROUND

Braun Electric was the sub-contractor for permit 16-1238. The work was completed by and invoiced by Todd Burns D.B.A. Southland of Brevard. Braun Electric allowed Burns to use his license for permitting.

6/8/16	Contractor Complaint was investigated by City of Fort Pierce
6/23/16	Probable Cause found.
6/27/16	Notice of Hearing sent to Frederick C. Braun

FINDINGS

1	Investigator Coss has determined that Todd Burns was not an employee of Braun Electric at the time of the infraction.
2	Braun Electric was aware that his license was being utilized for work that Braun Electric did not perform.
3	Investigator Coss alleges that the following sections have been violated; 5-52(3)(15)

ALLEGED CHARGES:

5-52 (3)(15)

(3) Committing incompetency or misconduct in the practice of contracting.
(15) Knowingly combining or conspiring with an uncertified or unregistered person by allowing his certificate or registration to be used by the uncertified or unregistered person with intent to evade the provision of this Code. When a certificate holder or registrant allows his certificate or registration to be used by one (1) or more business organizations without having any active participation in the operations, management, or control of such business organizations, such act constitutes prima facie evidence of an intent to evade the provisions of this Code.
