Waiver of Distance Application for 2 COP Alcoholic Beverage License - Wood Fyah Bar & Grill, 2164 N US Highway 1.

SUBJECT:

Review and approval of an application for a Waiver of Distance submitted by Applicant; Wood Fyah Bar & Grill to acquire 2 COP License for Sale of Beer and Wine for Consumption on Premises and Package Sales of Sealed Containers on a parcel  located at 2164 North US Highway 1, Fort Pierce, FL. The property is zoned C-3, General Commercial (Parcel ID 1433-440-0009-010-1).
 

SUMMARY:

  • The applicant is requesting a 2 COP license to serve beer and wine for consumption on premises in a restaurant.
  • There are two (2) licensed establishments located within 1,600 feet of the proposed establishment, therefore,the applicant is requesting a waiver of the minimum required distance of 1,600 feet between the applicant’s establishment, and two neighboring licensed establishments.
  • The proposed restaurant has a gross floor area of approximately 3,440 square feet and is planned to seat 65 patrons.
  • At their September 13th, 2016 meeting, the Planning Board voted unanimously, to recommend approval of the Waiver of Distance with the staff recommended condition.
  • A total of 13 notifications of the proposed Waiver of Distance were mailed to the owners of the properties located within 500 feet of the subject property.  As of September 23, 2016, no responses have been received, an update will be provided to the Commission.
     

RECOMMENDATION:

Approval with condition that the applicant provides a site lighting assessment to ensure the site lighting meets the minimum average of two (2) foot-candles, as required by City Code, and upgrade the lighting if necessary, prior to release of the alcohol license.
