SUBJECT:

Reduce code enforcement lien associated with 708 Grandview Boulevard, Ft. Pierce, FL, Parcel ID #2422-711-0008-000-1 previously owned by Rudaina Ibrahim, 708 Grandview Boulevard, Ft. Pierce, FL and currently owned by Qamar Wahaj, 233 SW Whitmore Drive, Port St. Lucie, FL 34984 in the amount of $22,330.00 ($30.00 recording fees) to $1,350.00 contingent upon payment of the reduced amount in 90 days.

SUMMARY:

  1. Mr. Wahaj purchased the subject property at a foreclosure auction on January 22, 2016.
  2. The violations were incurred by the previous owner January, 2005 and was corrected by previous owner in September, 2005.
  3. In 2007 previous owner requested a lien reduction which was approved by the City; however, due to non-payment it reverted back to the original amount.
  4. October 2016 learned that a foreclosure took place on the property but the City's lien was filed prior to the Lis Pendens.  It did not list the City as a party; therefore, the City's lien is valid.
  5. November 15, 2016 Special Magistrate heard the request for reduction and recommends the City Commission reduce the lien from $22,330.00 ($30.00 recording fees) to $1,350.00 payable in 90 days.

RECOMMENDATION:

Staff recommends reducing the code enforcement lien from $22,330.00 ($30.00 recording fees) to $1,350.00 payable in 90 days.

Deny request.
Determine alternative amount.
