SUBJECT:
Request to reduce code enforcement lien in the amount of $1,400.00 against 1114 Raymond Avenue, Ft. Pierce, FL 34950 - Parcel ID #2416-602-0089-000-8 - previously owned by David Burge, 1114 Raymond Avenue, Ft. Pierce, FL 34950 and currently owned by Vitangelo R. Bitetto, 1484 SE Village Green Drive, Port St. Lucie, FL 34952 to $748.86 payable in 60 days or at close of sale whichever comes first and to waive the $250.00 administration fee that may be imposed by the City Commission.
SUMMARY:
- Mr. Burge was responsible for the violations and the assessed fines.
- Mr. Burge went before the Special Magistrate and the City Commission in 2003. The $1,400.00 lien was reduced to $948.86 with no deadline for payment.
- Mr. Bitetto purchased the property in 2005 and the lien did not show up on a title search.
- The title company who conducted the search is no longer in business.
- Mr. Bitetto is attempting to sell the property as he can no longer financially sustain it.
RECOMMENDATION:
The Special Magistrate heard Mr. Bitetto's request and recommends to the City Commission to reduce the lien to $748.86 to cover the basic administration costs incurred by the city payable in 60 days or at the close of sale; whichever, comes first.
Additionally Staff recommends the City Commission waive the Administrative Fee of $250.00 that may be imposed by the City Commission for reduction requests placed before them for consideration.
