BACKGROUND

Ms. Mustafa indicated that Sunrise City Community Housing Development Organization (CHDO) began working with her in May of last year.  She said she was mostly communicating with Manny Estrada, even though she said she wanted to speak to the contractor (Mr. Waller).  Work had begun in May of 2017 before a permit was obtained (in mid-July), and a Stop Work Order was put in place.   Work was on hold for two weeks while Mr. Waller said he would speak with the Building Department.  
Ms. Mustafa was never given a contract by Mr. Waller, and they used bad language on the phone with her when she tried to communicate with them about the project - and as of December of 2017, had not returned her calls until the Notice of Complaint had been received by them.

TIMELINE

May 8, 2017 Ms. Mustafa provides a check in the amount of $2,250.00 as a deposit for a kitchen remodel.
July 14, 2017 Permit 17-2010 is applied for by Mr. Waller.
July 11, 2018 Ms. Mustafa files a Contractor Complaint with the Building Department
July 12, 2018 Mr. Waller is sent a Notice of Complaint
July 24, 2018 Mr. Waller provides a response to the Complaint
July 30, 2017 Mr. Waller is sent a Notice of Hearing
August 14, 2018 Item is continued.
August 16, 2018 Mr. Waller is sent Order and Notice of Continuance.

ALLEGATIONS

Ms. Mustafa indicated that she was misled about work begun without a permit, while she thought everything was in order, which resulted in a Stop Work Order from the Building Department.   Manny Estrada, an employee of CHDO, was the employee communicating with her.   CHDO required $2250.00 for engineering fees to submit the plans.   As of December the company wll not return her calls.

 

ALLEGED CHARGES:

5-52 (2) Committing fraud or deceit in the practice of contracting.
5-52 (3) Committing incompetency or misconduct in the practice of contracting.
5-52(4) Committing gross negligence, repeated negligence,  or negligence resulting  in a significant danger to life or property.
5-52(5) Abandoning a construction project in which the contractor is engaged or under contract as a contractor. (A project may be presumed abandoned after ninety days if the contractor terminates the project without just cause or without proper notification to the owner, including the days.)
5-52(8) Knowingly or deliberately disregarding or violating any applicable building codes or laws of the state, county or city;
5-52(13) Proceeding on any job without obtaining the applicable building department permits and inspections.

RECOMMENDATION:

To be determined at the hearing.
