SUBJECT:

Approve request to reduce code enforcement liens in the amount of $1,151,740.00 against 1610 N 25th Street, Ft. Pierce, FL 34950, Parcel Number 2404-610-0001-000-6 previously owned by 26 Investment LLC, 20 Maple Avenue #30B, Fair Lawn, NJ 07410 and currently owned by FB Royal Garden LLC, 10325 NW 7th Avenue, Miami, FL 33150 to $33,000.00 payable in 60 days.

SUMMARY:

  • The violations and the accrued fines were initiated when the property was owned by the previous owner, 26 Investments LLC. 
  • The current owner (FB Royal Garden LLC) is responsible for the violations being corrected and requesting the reduction of fines.
  • FB Royal Garden LLC confronted multiple obstacles while bringing the property into compliance. They have made a significant investment into the property to bring it up to code.

RECOMMENDATION:

The Special Magistrate heard the request of Ilan Bally, owner of FB Royal Garden LLC, to reduce the liens assessed against the property. She recommends to the City Commission to reduce the liens to $33,000.00 ($3,000 per lien / 11 liens) to cover the administration costs incurred by the City.

In addition, Staff recommends the City Commission waive the Administrative Fee of $250.00 that may be imposed by the City Commission for reduction requests placed before them for consideration .
