SUBJECT:

Request to reduce code enforcement lien in the amount of $44,040.00 against 619 S 17th Street, Ft. Pierce, FL 34950 - Parcel ID #2409-712-0120-000-4 - owned by Shawnawati Bisesar, 105 S. 21st Street, Ft. Pierce, FL 34950 to $500.00 payable in 30 days and to waive the $250.00 administration fee that may be imposed by the City Commission.

SUMMARY:

  • The requestor is the property owner and she is responsible for the accumulation of fines. Digbijai Rai, her brother-in-law,  has power of attorney.
  • Mr. Rai disputed the code officer's report that the violations were not done in a timely manner.  He hired a licensed contractor, Ray Villanova, to obtain the permit and to communicate with the building inspector, Shaun Coss.
  • They are requesting the fines be waived but was willing to pay $500.00 to satisfy the lien.

RECOMMENDATION:

The Special Magistrate heard the property owner's request and recommends to the City Commission to reduce the lien to $500.00, to cover the administration costs incurred by the City, payable in 30 days.

Additionally, Staff recommends the City Commission waive the Administrative Fee of $250.00 that may be imposed by the City Commission for reduction requests placed before them for consideration.

OTHER INFORMATION:

The Fiscal Impact could vary based on the decisions made by the City Commission concerning requests for reduction/rescindment of code enforcement liens.
$500.00 to the general fund providing the City Commission approves the reduction request as recommended by Staff.
$750.00 to the general fund should the City Commission impose the $250.00 administrative fee established by Rules of Procedure
Section 17 (e) for any requests for mitigation of a code enforcement lien heard by the City Commission.
