SUBJECT:

Approve request to reduce the Building Department lien in the amount of $16,130.00 against 119 N 11th Street, Fort Pierce, FL 34950 - Parcel ID Number 2409-516-0017-000-7 owned by Atlantic 509 LLC, 709 Neapolitan Way, Naples, FL 34103, to $1,435.36 payable in 30 days.

SUMMARY:

The request for reduction is made by Atlantic 509 LLC, owner of the property.  The owner was mislead, by a tenant, to believe that the violations were addressed when they had not been.  Once the owner was made aware, the violations were addressed, and the violation case was complied.  During the lapse of time, fines accrued and a lien was recorded. At the Massey Hearing before the Special Magistrate, she agreed to staff's recommended reduction to $1,435.36 payable within 30 days. 
 

RECOMMENDATION:

The Special Magistrate, having heard the request of the owner and testimony from staff, recommends reducing the lien to $1,435.36 payable in 30 days.  If not paid within the 30 days, the lien will revert to the original amount $16,130.00.
