SUBJECT:
Approval of $15,000 payment to VUEWorks, LLC in settlement of software contract claim.
SUMMARY:
This lawsuit was brought by VUEWorks, LLC, a former software provider, seeking damages and legal costs resulting from their breach of contract claim. Management and this office recently engaged in informal settlement discussions seeking to limit the City's exposure to continued litigation expenses and a possible adverse judgment. The case can be settled for $15,000, each party to pay their respective fees and costs, and a general release to be issued by VUEWorks.
RECOMMENDATION:
Both the City Manager and this office recommend this settlement, which requires Commission approval.
ALTERNATIVES:
Staff will proceed as directed by the City Commission.
