SUBJECT:
Moved from Item 13b - Resolution No. 22-R08 and Quasi-Judicial Hearing – A hearing to allow the owners and/or parties of interest in the property identified as 505 N 13th Street to show cause why the structure located on the premises should not have been condemned and demolished.
SUMMARY:
- December 9, 2015 - Structure was originally condemned by Building Official Marc Meyers.
- December 13, 2017 - New Affidavit of Unsafe Structure issued initiating condemnation under new Rules of Procedure.
- September 2018 - City secured the structure.
- March 2, 2020 - City Commission adopted Resolution 20-R13 setting hearing date of April 6, 2020 for a demolition hearing.
- COVID-19 - All quasi-judicial hearings canceled.
- September 2020 - Property was sold at tax sale auction.
- November 1, 2021 - Notice sent to new owner advising that condemnation action will resume if no affirmative action is taken to correct the violations.
- December 2021 - Condemnation case reviewed by Building and City Attorney and approved to move forward.
- January 30, 2022 - Property caught fire.
- January 31, 2022 - Building Official Paul Thomas declared the structure and imminent threat and ordered its immediate removal.
RECOMMENDATION:
Staff recommends the City Commission approve Resolution No. 22-R08 declaring that the structure located at 505 N 13th Street was condemned and demolished in accordance with the Rules of Procedure for Condemnation and Demolition as adopted by the City Commission.
