SUBJECT:
Quasi-Judicial Hearing - Review and approval for a Conditional Use with New Construction, by property owner, Daniel B. Longman, and representative, John Brockhausen of LBJ Architecture to construct a two-story garage and guest house at the height of 33.7 feet (approximately 34 feet) at or near 1506 Thumb Point Drive in Fort Pierce, Florida, more specifically located at Parcel Control Number: 2401-605-0019-000-0.
SUMMARY:
In accordance with Sections 125-37, 125-191, and 125-237 of the City Code, the applicant is requesting the review and approval for Conditional Use to construct a two-story garage and guest house at the height of 33.7 feet (approximately 34 feet). Per City Code Section 125-191 (4) Building heights, no building shall exceed a height of 28 feet above grade, except that conditional uses with buildings that have a maximum height of 35 feet above grade may be approved. Per City Code Section 125-191 (c)(2), On any lot used for residential purposes, no more than one residential building will be allowed on the lot, except one building without kitchen facilities may be allowed as a guest house, provided that the lot on which such guest house is located is 30,000 square feet or more in size. The survey submitted lists the property being a total of 37,748 square feet. Therefore, a guest house without kitchen facilities is an allowed use.
This is a resubmittal of the proposed conditional use for a total roof peak height of 33.7 (approximately 34 feet). Originally, the applicant’s submittal was not clear about the height, setbacks, and whether there are kitchen facilities. The applicant has submitted plans with clarification to all previous concerns.

RECOMMENDATION:
The proposed Conditional Use application adheres to the requirements of the City Land Development Code and guidelines of the City’s Comprehensive Plan and does not appear to adversely affect the public health, safety, convenience, and general welfare. Therefore, Staff recommends APPROVAL with the following condition:
- The owner adheres to the letter and plan submitted by the architect dated December 1, 2022.
