SUBJECT:
Resolution No. 23-R35 Authorizing the release of mineral rights on property located on Boston Avenue which was previously sold pursuant to Resolution 22-R26.
SUMMARY:
This Resolution addresses mineral rights related to a property on Boston Avenue, Parcel ID 2410-701-0076-000-0 (Property). The Property was purchased in 1991 by the City for the use and benefit of the FPUA. The FPUA entered into a purchase and sale agreement with Paul H. Hemingway and Laurel Mae Hemingway (Hemingways) on June 7, 2022. Therefore, ownership of the Property was transferred to the Hemingways via Warranty Deed, authorized by Resolution 22-R26 of the City Commission. Pursuant to section 270.11, Florida Statutes, certain phosphate, mineral, metal, and petroleum rights (Mineral Rights) were automatically reserved to the City pursuant to the 2022 Warranty Deed. The petition submitted by the Hemingways is to release any Mineral Rights statutorily reserved to the City and the FPUA.
RECOMMENDATION:
Staff recommends approval.
