SUBJECT:

Approve waiver of all lot clearing costs, interest, penalty and administrative fees in the amount of $574.69 for Lot Clearing Lien against 405 N 6th Street, Property ID #2410-603-0043-000-9 owned by John B. Allman, 45 Rio Vista Drive, Stuart, FL 34996.

SUMMARY:

Mr. Allman purchased the property on June 16, 2003. On or about the same day, the City had the lot cut by a vendor. A title search was completed but as the lien had not been filed at that time, no record was found. Mr. Allman was not provided his due process.

RECOMMENDATION:

Due to the fact that Mr. Allman was not provided due process, staff recommends waiving all fees including interest, penalties, administrative and lot clearing charges for a total amount of $574.69.

ALTERNATIVES:

  1. Deny the request.
  2. Determine alternative amount.
