SUBJECT:
Approval of an amendment to the City's annual Traffic Signal Maintenance and Compensation Agreement with the Florida Department of Transportation (FDOT) pending approval of the City Attorney.
SUMMARY:
The FDOT has supplied all Signal Maintaining Agencies an amendment to their annual "Maintenance and Compensation Agreements". The amendment is a revision to the terms and conditions of the agreement.
Summary of changes are as follows:
Added Department of Financial Services standard terms so agreements stand up to financial review.
Simplified language for penalties and retainage.
Changed responsibility for pursuing 3rd party damage insurance from Maintaining Agency to FDOT
Added requirement to provide annual report of traffic signal maintenance log.
Added Force Majeure clause to remove liability from Maintaining Agency and FDOT in the event of an Act of God, etc.
Increased time to repair critical detectors from 60 days to 90 days
Decreased mandatory annual inspections of State Signals from 100% to 50% of signals annually
