SUBJECT:
Approval of the settlement of the City's opioid litigation against six (6) Remnant Defendants and authorization for the Mayor to execute the Six (6) Remnant Defendants' Combined Subdivision Participation and Release Form ("Combined Participation Form").
SUMMARY:
On August 2, 2021, the City Commission passed Resolution 21-R44 approving participation in the settlement of a nationwide class action lawsuit against the makers and distributors of certain opioid drugs. The next step in the settlement process is the execution of participation forms/agreements. The participation forms/agreements release all claims against the settling defendants in exchange for the payment of settlement funds. Such funds will be distributed to Fort Pierce in accordance with regional and statewide agreements. This Combined Participation Form approves and authorizes the settlement of the City's opioid litigation against six (6) Remnant Defendants: (1) Associated Pharmacies, Inc. (and American Associated Pharmacies), (2) J M Smith Corporation, (3) Morris and Dickson Co., L.L.C., (4) Louisiana Wholesale Drug Company, Inc., (5) North Carolina Mutual Wholesale Drug Company, Inc., and (6) United Natural Foods, Inc. (and SuperValu).
