Lease for Steam Locomotive Association #253

SUBJECT:

Request to provide notice of intent to terminate the lease at 1401 N 2nd Street. 

SUMMARY:

In 2008 the City entered into a lease agreement with the Steam Locomotive Association #253 to lease a portion of the property at 1401 N. 2nd Street. At the time, that property was also occupied by PAL providing recreational opportunities for the City's youth. PAL moved out approximately two years ago and this property was recently declared surplus, and is actively being marketed.  In anticipation of a sale or lease, Staff is requesting lease termination. Section 18 of Lease (attached) indicates that either party may give written notice of intent to terminate the lease with three (3) months notice.   Staff has been working with Steam Locomotive Association #253 to relocate to a new location.   While the lease terms call for three month notice, it is possible that a new buyer would give them additional time. Furthermore, Staff will work with any new buyers to ensure a smooth transition. 

RECOMMENDATION:

Approval of recommendation to terminate the lease with Steam Locomotive Association #253 for the property at 1401 N 2nd Street, providing three (3) months notice. 

ALTERNATIVES:

FPRA Board may discuss and provide guidance.
