SUBJECT:
Approval of an extension for the Planned Development (PD) Approval for the project commonly known as Villages of Midway, located on northside of Midway Road and west of I-95. This project was originally approved on April 4, 2016 via Ordinance No. 16-009. The new date for the site plan expiration would become April 7, 2020.
SUMMARY:
- The Applicant's Representative, Lee Dobbins of Dean Mead Law Firm is requesting an extension based upon three of the Governor's Executive Orders. Executive Orders address declared disasters by giving applicants additional extensions of time for applicants who request the extension.
- Florida Statute 252.364 sets forth the extension of expiration date for emergency orders.
- The Applicant's Representative is requesting extensions for Executive Order 17-174, 17-204 and 17-235 signed by Governor Rick Scott.
- When separate emergency events triggering the extension overlap, the period of the overlap is counted once and not added together.
- This project was initially approved on April 4, 2016 with a two year approval to commence, this approval would expire on April 4, 2018. However, the Governor's Executive Orders now extend the expiration to April 7, 2020.
RECOMMENDATION:
Approve the extensions based on the State of Florida Executive Orders issued by Governor Rick Scott.
ALTERNATIVES:
Staff will proceed as directed by the City Commission.

OTHER INFORMATION:
This is one of the largest undeveloped projects in Fort Pierce, extending the site plan assists in its future development.
