SUBJECT:
Quasi-Judicial Hearing - A hearing to allow the owners and/or parties of interest in the property identified at 323 N 14th Street to show cause why the structure located on the premises should not be condemned and demolished.
SUMMARY:
- The structure located at 323 N 14th Street was initially declared unsafe under the International Property Maintenance Code by Building Official Marc Meyers on 10/8/2015.
- No action was taken by the owner or the mortgage holder to remediate the condition of the structure.
- The building was inspected again on 11/30/2017 due to a 3rd fire at this location. It was again declared unsafe and condemnation for demolition proceedings under the newly adopted Rules of Procedure for Condemnation and Demolition were initiated.
- The owners have provided written confirmation as to having no interest in the property due to losing the property in bankruptcy.
- The mortgage holder has likewise relinqueshed all interest in the property.
RECOMMENDATION:
Staff recommends the City Commission approve Resolution No. 18-R09 declaring that the structure located at 434 N 14th Street be condemned and demolished in accordance with the Rules of Procedure for Condemnation and Demolition as adopted by the Commission.
ALTERNATIVES:
Grant the owners or other interested parties additional time to correct the condition of the structure.

OTHER INFORMATION:
The cost of demolition, if required to be conducted by the City, will be funded by the Clean & Safe Initiative and shall become a lien against the property.
