SUBJECT:

Resolution No. 18-R13 and Quasi-Judicial Hearing - A hearing to allow the owners and/or parties of interest in the property identified as 426 N 10th Street - Rear Unit AKA 427 Dundas Ct to show cause why the structure located on the premises should not be condemned and demolished.

SUMMARY:

  1. The structure located at 426 N 10th Street (rear unit) AKA 427 Dundas Court was iniially declared unsafe under the International Property Maintenance Code by Building Official Marc Meyers on 4/4/2014.
  2. No action was taken by the owner to remedy the condition of the property. the property is now in an estate.
  3. The building was inspected again on 09/21/2017 and was again declared unsafe and condemnation for demolition proceedings were initiated.
  4. The daughter of the prior owner (estate) has been in contact with the City on multiple occasions. Due to her health and current financial situation, she is unable to facilitate the demolition of the structure. As a result of the continued deterioration and vandalism to the structure, she has requested the City take the necessary action to remove the building.

RECOMMENDATION:

Staff recommends the City Commission approve Resolution No. 18-R13 declaring that the structure located at 426 N 14th Street (rear unit) AKA 427 Dundas Court be condemned and demolished in accordance with the Rules of Procedure for Condemnation and Demolition as adopted by the City Commission.

ALTERNATIVES:

Amend Resolution No. 18-R13.
Deny Resolution No. 18-R13.

Fiscal Impact

OTHER INFORMATION:

The cost of demolition, if required to be conducted by the City, will be funded by the Clean & Safe Initiative and shall become a lien against the property.
