VIOLATIONS:
Section 5-1.105.1 (2017) Permit Required, Section 105.4.1.2 (2017) Expired Permit
CORRECTIVE ACTIONS:
Updated Status as of 4/15/2021:
- Permit 18-235 for the sitework has expired. Additionally, the site improvements that have been made are not consistent with the sitework permit. Submit a revision and renew the permit to reflect actual site conditions and any other proposed changes including but not limited to the following:
- The pouring of slabs throughout the site.
- The fabrication of the containment zone area including slabs, concrete walls, and sump pumps.
- Provide an equipment layout for all asphalt processing equipment.
- Provide attachment details for all asphalt processing equipment that is not portable and readily movable. This includes all equipment that is on stands, anchored to the ground and/or slabs.
- If necessary, correct the location of the “office” container/trailer and the “testing lab” container/trailer; see number 2 below.
- Permit 19-3466, is for the placement of a shipping container to be used as a “testing lab”. Within this permit application, the location of this container is indicated to be along the eastern edge of the leased property. However, as indicated in 1(e) above, the “office” container/trailer is to be located along the eastern edge of the leased area. Confirm the location of “testing lab” container/trailer. Either the sitework permit or this permit will need to be revised to provide the correct location.
- As indicated as a permit condition of the sitework permit, a separate permit is required for the placement of the “office” container/trailer. The “office” and “testing lab” have both already been installed prior to the issuance of separate permits. Obtain all necessary permits.
- Electrical work performed under permit 19-3466, which has not been issued, has already been completed. This work was not inspected in conjunction with permit Permit 19-1304.
- A “Temporary Use Agreement” with the Building Department is required. The Temporary Use agreement is different than the temporary use which may be authorized by the Engineering and Planning Departments. Please Contact Karen Murphy, Executive Assistant to the Building Official to schedule a meeting in regards to the Temporary Use Agreement. Karen may be reached at (772) 467-3188 or kmurphy@cityoffortpierce.com.
RECOMMENDATION:
The City requests that if the Special Magistrate finds the violation exists, the violator(s) be given 180 days to obtain a permit; obtain approval for all required inspections at least every 180 days until the permit has been closed; comply with all other permit conditions; and, cure all other violations described in the Order not requiring a permit or a fine of $100.00 per day be assessed.
