SUBJECT:

Quasi-Judicial Hearing - Application for Site Plan (Development and Design Review) submitted by property owner, Jill Simpkins, OkeeJen LLC and applicant, Todd Howder, Vice President– MBV Engineering, Inc., for Fort Pierce Commercial located at 5553 and 5555 Okeechobee Road to construct a 241,190 square foot commercial development with retail and a restaurant on Parcel 1, Aldi grocery store on Parcel 2 and future commercial development on Parcel 3. The property is zoned General Commercial (C-3). Parcel ID(s): 2419-321-0001-000-5 and 2419-322-0003-000-2.

SUMMARY:

In accordance with Sections 125-37, 125-313, and 125-314 of the City Code, the applicant is requesting the review and approval for Site Plan (Development and Design Review) to construct a 24,190 square foot master commercial development with retail and a restaurant on Parcel 1, Aldi grocery store on Parcel 2 and future commercial development on Parcel 3.
 
This project proposes a Master Commercial Development parcel with an overall area of 12 acres. The master development will be divided into four (4) separate parcels as described below:
 
  • Parcel 1: 1.26 acres parcel containing a 2,448 sf Chipotle Restaurant and 2,533 sf retail building
  • Parcel 2: 2.96 acres parcel containing a 19,209 sf ALDI Grocery Store
  • Parcel 3: 4.35 acres parcel (3.06 acres net developable) for future commercial development
  • Parcel 4: 3.44 acres Stormwater Tract
 
The Master Developer will retain ownership of the land and enter into land-lease agreements with the individual parcel users. The development will be designed to provide master infrastructure improvements consisting of roads, water and sewer lines, stormwater, gas and electric.
 
The Developer will be responsible for the design and permitting of the master infrastructure and will prepare “pad-ready” sites for Parcel 2 and Parcel 3. Utility stubs will be provided to each parcel for the individual development to connect to.
 
Parcel 4 is the proposed stormwater tract that will provide the required stormwater treatment and attenuation for the Master Development.
 

RECOMMENDATION:

The proposed Site Plan (Development and Design Review) applications adhere to the requirements of the City Land Development Code and guidelines of the City’s Comprehensive Plan and does not appear to adversely affect the public health, safety, convenience, and general welfare. Therefore, Staff recommends APPROVAL of the requested applications with the following conditions:
 
  1. Per City Code Chapter 121 Subdivisions, a Preliminary and Final Plat are required.
  2. A completion certification by a landscape architect, cost estimate and landscape bond pursuant to City Code 123-6 shall be required before the Final Certificate of Occupancy is approved for the site.  
  3. Prior to the issuance of any site clearing permits, the applicant shall provide a Tree Mitigation Survey and coordinate with the City of Ft. Pierce Arborist for the required mitigation of the City regulated trees proposed to be removed as a result of this site’s development/construction activity.
