SUBJECT:

Public Hearing - Resolution No. 22-R11 designating the property at 100 Blue Sky Circle, Fort Pierce, Florida 34947, identified by Parcel ID Numbers 2419-211-0004-000-8 and 2419-211-0004-010-1, as a Green Reuse Area pursuant to § 376.80(2)(c), Florida Statutes. FIRST READING

SUMMARY:

The City of Fort Pierce has received a request from The Goldstein Environmental Law Firm, P.A., on behalf of Blue McNeil One, LLC and Blue McNeil Two, LLC (together, “Blue McNeil”) for the designation of the property located at 100 Blue Sky Circle, Fort Pierce, the “Blue Sky Landing Green Reuse Area” pursuant to Chapter 376.80(2)(c), Florida Statutes.

Blue McNeil is requesting the designation due to the presence of contamination that exists on the property arising out of its historical agricultural use from at least the 1940s until the 1980s. Agricultural use of property is associated with the application of chemical pesticides, herbicides, and fertilizers which can accumulate in soil over time resulting in localized soil or groundwater impacts. According to the request packet, the presence of contamination has complicated redevelopment for Blue McNeil by increasing the potential exposure to environmental and regulatory liability if actual contamination is discovered as redevelopment progresses. The applicant indicates the designation has become a key part of the project’s ultimate viability by enabling Blue McNeil to access certain state-based regulatory and economic incentives to mitigate and manage the risk and expense associated with the property’s historical use and the necessary response, if required. It is also key to furthering the sustainable reuse of this property in a growing area of Fort Pierce. When fully redeveloped as a two-phase affordable multifamily residential rental community, the property will contain 164 units in four buildings with a standalone clubhouse and community amenities will include on-site laundry, a pool, and a fitness center. The applicant states that the completed project will be built at a cost of approximately $42.2 million for both phases.

In their request, the applicant has addressed the statutory criterial in 376.80(2)(c), and concludes the subject property meets the definition of a “brownfield site” and satisfies the five statutory criteria for designation.

As required by 376.80, Florida Statutes, adoption of a Resolution designating a brownfield area requires two public hearings.

RECOMMENDATION:

Staff finds that the applicant has demonstrated this site/project meets the 5 statutory criteria for designation as a Brownfield site as set forth in Section 376.80(2)(c), Florida Statutes, and as such, recommends approval of the first reading of Resolution No. 22-R11.

Amend or deny Resolution No. 22-R11.
