Lien Reduction Request - 1012 N 22nd Street

SUBJECT:

Request to rescind all code enforcement fines in the amount of $21,790.00 (includes $40.00 recording fees) against 1012 N 22nd St., Ft. Pierce, FL previously owned by Lois Mitchell (Est) and Theresa Spears, 2098 SW Brisbane St., Port St. Lucie, FL 34984 and currently owned by Jasmine Wimes, 1012 N 22nd St., Ft. Pierce, FL .

SUMMARY:

BACKGROUND:
  1. The case was initially filed against the previous owner for storing indoor furniture outside and they were given 10 days to put the furniture inside or be assessed a fine.  Due to non-compliance, a lien was recorded July 2009.
  2. Jasmine Wimes inherited the property from her parents who had received it from the previous owners and was not aware of the lien on this property.

RECOMMENDATION:

The Code Enforcement Board heard Ms. Wime's request and after considering the 7 Criteria required for reduction and discussing the case their recommendation to the City Commission is to rescind the fines leaving a $.00 balance.

This recommendation is based on:
  1. Ms. Wimes inherited the property.
  2. Ms. Wimes is a full time student and works part time.
  3. The property is current in taxes and she is maintaining the property according to city ordinances.
  4. She is a young woman trying to keep the property current, go to school, work part time.  She has applied to the Housing Rehabilitation Program for assistance.
  5. Ms. Wimes also has a lot clearing and demolition lien on another property and has come to the City Commission for an extension on paying it.

ALTERNATIVES:

Deny request.
Determine alternative recommendations.
