FINDINGS/ORDER:

February 1, 2012 Special Magistrate Blandino found that Rita J & Roy D Richardson was in violation of the code section(s) listed above and ordered the violations to be corrected within 30 days or a fine of $250.00 per day would be assessed.

ACTION DATES:

  1. February 27, 2012 an inspection was made; the property was not in compliance, the fines began.
  2. February 11, 2013 the Order Assessing Fine and Imposing Lien was recorded.
  3. June 23, 2015 received notice of tax deed sale -excess proceeds from the Clerk of the Circuit Court.
  4. July 24, 2015 received a check in the amount of $31,111.00.   Staff notified new owners of the excess funds and that there were current liens on property: one lot clearing and two code enforcement liens.
  5. August 11, 2015 the property was brought into compliance; the fines were stopped.
  6. August 24, 2015 received Request for Lien Reduction from Feroz Chagani.

RECOMMENDATION:

The total amount of this lien is $315,290.00 ($40.00 recording fees).

Staff recommends accepting a portion of the excess funds, $24,000.00, as settlement of the lien. The remaining balance shall be applied to the lot clearing lien and the second code enforcement lien.
