Allowing Higher Fences Adjacent to the Railroad Right of Way (ROW)
SUMMARY:
Proposed zoning code change to permit properties abutting a railway line or railway right of way to erect a fence of up to eight (8) feet in height along the rear and side property lines within the rear yard area. The maximum height for fences within the front yard setback shall remain as provided in the zoning district. The existing city code restricts the maximum height of fences in rear yard areas within residential districts to 6ft at Sec. 125-322 (c).
RECOMMENDATION:
Approve the code amendment to allow fences up to 8ft in height adjacent to the Railroad ROW.
