SUMMARY:

A Waiver of Distance application has been submitted for review by 908 Ave. D Food Market. The property is located at 908 Ave. D, Parcel ID 2410-601-0086-000-6. The applicant is seeking approval so that a 2APS alcohol license can be granted for off-premise consumption. 

RECOMMENDATION:

After review of the submitted documents by the applicant, Staff recommendation is to Not Approve the 'waiver of distance' due to the following unmet conditions:
  1. Unimproved landscape according to Sec. 123
  2. Bring up to code, Access Control Sec. 125-316
  3. Parking not brought up to code according to Sec. 125-315
  4. Unmet accessibility requirements:
    1. ADA parking space(s)
    2. Means of egress
    3. Accessible route

ALTERNATIVES:

  1. Recommend Approval with additional or no conditions.
  2. Recommend Disapproval.
