SUBJECT:
Quasi-Judicial Hearing - Review and Approval of an application for a Conditional Use: No New Construction by applicant Lany & Claudel Romulus, to operate New Elite Academy, daycare center in the 7,711 sq. ft. building with associated site improvements, located at 2210 Orange Avenue, more specifically Parcel Control Number 2409-602-0010-000-2.
SUMMARY:
The proposed building will undergo modifications for eight (8) classrooms with adjoining restroom, electrical and plumbing updates with secure access, installation of an exterior mulch playground and build out kitchen. An estimate of 152 children will be serviced, ranging from age 6wks up to 5 years old. Hours-of-operation is from 5a-6pm.
The property is in the C-3, General Commercial zoning district and has a Future Land Use designation of GC, General Commercial.
According to Article 5: Section 125-325, the purpose of the conditional use process is to allow, when desirable, uses that would not be appropriate generally or without restriction throughout the particular zoning district, but which, if controlled as to number, area, location or relations to the neighborhood, would not adversely affect the public health, safety, comfort, good order, appearance, convenience and the general welfare.

RECOMMENDATION:
The proposed Conditional Use: No New Construction application adheres to the requirements and guidelines of teh City's Comprehensive Plan. Therefore, staff recommendation is for City Commission to Approve the submitted application with the two (2) conditions:
- Sign permits should be applied for prior to the issuance of Certificate of Occupancy (CO)
- A notarized landscape maintenance agreement is due prior to the issuance of CO

- Recommend disapproval
