VIOLATIONS:
Section 123-64(a) - Tree: Removal without a permit
RECOMMENDATION:
The City requests that the Special Magistrate find the following:
- Per State Statute 162.09(2)(a), the violation is determined to be irreparable or irreversible in nature.
- Given the size of the protected tree (47.3" DBH), staff recommends imposing the maximum penalty of $5,000.00.
- The violator(s) be assessed a fine in the amount of $5,000.00, to be paid within 30 days to the City tree fund.
