SUBJECT:

Approval of Statewide Mutual Aid Agreement with the State of Florida, Division of Emergency Management (FDEM).

SUMMARY:

The City of Fort Pierce last signed a Statewide Mutual Aid agreement with the State of Florida, Division of Emergency Management in 2020. The State is requesting that all parties review and approve the updated agreement. This agreement will provide a structured document for assistance to the City if needed during a "major disaster" or "catastrophic disaster" as defined in Section 252.34, Florida Statutes, minor disasters, and other such emergencies as lawfully determined by a participating party. It also provides for the City to offer assistance to other agencies in need throughout the State when requested. The agreement affords a method for reimbursement of expenses for aid provided or received.

Attachment "B" - (COD Amendment) to the Statewide Mutual Aid Agreement was requested by Chasity Brown, from the Florida Division of Emergency Management, as a measure to provide the State assistance to assure that all City Departments are included in the Mutual Aid agreement, in order for timely reimbursement to the City for any mutual aid services provided at the request of the State during an emergency. The referenced City of Fort Pierce Amendment (Attachment "B") does not alter any part of the Mutual Aid Agreement, and provides further protection to the City to guarantee reimbursement. The Mutual Aid Agreement will remain in effect for one (1) year from its date of execution and will automatically renew unless notice is given sixty (60) days prior to the agreement's renewal date. This agreement has been reviewed and "Approved As To Form" by the Assistant City Attorney, Felecia Holloman.

As such, staff hereby recommends Commission approval of the referenced Statewide Mutual Aid Agreement with the State of Florida, Division of Emergency Management, as detailed herein.

RECOMMENDATION:

Staff recommends approval of the revised Statewide Mutual Aid Agreement with the State of Florida, Division of Emergency Management (FDEM). The State of Florida has updated the agreement and is requesting all parties to execute the new agreement.

ALTERNATIVES:

The City of Fort Pierce does not enter into the agreement.
