SUBJECT:

Request to reduce code enforcement fines in the amount of $95,240.00 against 2808 Oleander Avenue, Ft. Pierce, FL, Parcel ID# 2422-602-0136-000-2, which was previously owned by RWLS V Holdings LLC, PO Box 8451, Mesa, AZ 85214 and currently owned by Tatiana G. Flores, 2808 Oleander Boulevard, Ft. Pierce, FL 34982 to $200.00 payable in 30 days.

SUMMARY:

BACKGROUND:
A lien was placed on RWLS V Holdings LLC in January 2015. The property was sold to Roberto & Edith Flores but they were not notified of the existence of the violation or lien. Ms. Tatiana G. Flores inherited the property in November 2015. In January 2016, staff notified the new owner of the violation and she corrected the violation within two days. 

RECOMMENDATION:

The Special Magistrate heard the request on March 2, 2016 and recommends to the City Commission that they accept the offer of $200.00 payable in 30 days.

Recommendation is based on:
  1. The lien was on RWLS V Holdings who sold the property and did not inform the new owners of the lien. 
  2. Upon learning of the lien Ms. Flores immediately corrected the violation by removing the fence.

  1. Deny the request.
  2. Make alternative recommendations.
