SUBJECT:
Legislative Hearing - Ordinance 26-014 - Amending Chapter 113 regarding Impact Fees offsets and credits FIRST READING
SUMMARY:
The proposed code amendment addresses the issues discussed at the CC 3/16 meeting regarding Impact Fee Offset Requests in respect of capital projects/capacity improvements regarding projects located outside of the City’s Roadway network but within the St. Lucie County Roadway/ROW network.
With the current situation, applicants may dedicate ROW or construct roadway capacity outside City ROW as part of the development requirements attached to a planning application.
Under the current provisions of Chapter 113, those improvements may fail the City-CIP / City-ROW eligibility pathway, even if the improvements/dedication provide a broader system capacity.
The draft ordinance adds St. Lucie County/TPO transportation-need language and County impact fee credit recognition. Non-City ROW improvements may be considered if they create public transportation capacity and meet City and County eligibility standards.
The proposed amendment distinguishes an “opportunity to request” from an entitlement to receive a credit.
The proposed amendment allows an applicant to request City recognition of qualifying transportation improvements. Eligibility shall be based on City standards plus County credit standards and identified County/TPO transportation needs. The City Commission shall retain review and conditioning authority through an offset agreement.
Result: Is an opportunity for case-by-case, documented Transportation Impact Fee Offset/Credit.

RECOMMENDATION:
Staff recommend APPROVAL of the amendment to Chapter 113 to recognize impact Fee offsets and credits for certain Right of Way improvements which are consistent with St. Lucie County standards.

Approve the amendment with alternative language.

Requests are linked to the Transportation Impact Fee determined in respect to the development. Only the City’s portion of the Transportation Impact Fee due for development can be subject of offset/credit due.
These funds are restricted and have no impact on the City’s General Fund Budget.
Eligibility for any credit for the St. Lucie County portion of Transportation fees due will be determined separately by application to that agency.
