SUBJECT:

Authorize the City Attorney to initiate foreclosure action on a code enforcement lien filed against 7131 Okeechobee Road and Ft. Pierce Petroleum LLC.

SUMMARY:

  • 08/28/2012 - Code Enforcement case initiated due nuisance conditions and work being done to renovate the gas station without the proper permits.
  • 11/7/2012 - The Special Magistrate issued an Order Determining Violation.
  • 10/14/2013 - Due to continued non-compliance fines in the amount of $250.00 per day commenced.
  • 11/29/2013 - The Building Official signed a Notice of Unsafe Building, which was filed with the St. Lucie County Clerk of Court in Book 3577 Page 181
  • 01/24/2014 - An Order Assessing Fine and Imposing Lien was signed by the Special Magistrate and recorded with the St. Lucie County Clerk of Court in Book 3599 Page 915.
  • 08/02/2017 - In accordance with State Statute 162.09 and City Ordinance 2-247, this matter was presented to the Special Magistrate who recommended that the City Attorney move forward with foreclosure of the lien.

RECOMMENDATION:

Authorize the City Attorney to initiate foreclosure action on the Order Assessing Fine and Imposing Lien that was issued against 7131 Okeechobee Rd and Ft. Pierce Petroleum LLC and recorded in Book 3599 Page 915.

ALTERNATIVES:

Deny the request to initiate foreclosure action.
