SUBJECT:

Approval of contractual agreements for outside counsel to represent the City of Fort Pierce in related employment arbitration cases.  

SUMMARY:

     Due to a conflict of interest for the City Attorney arising due to multiple allegations of misconduct against the City Manager, Police Chief and the Chief Investigator in Holmes v. City of Fort Pierce and MacNaught v. City of Fort Pierce, it has been necessary to retain outside counsel for representation in the related cases.

     The law firm of Bell and Roper, P.A., was utilized for the employment arbitration matters related to these employment arbitration cases prior to the selection of Olds and Stephens, P.A., as outside counsel for these cases.  Moving forward, Olds and Stephens, P.A., will assume responsibility in both Holmes and MacNaught v. City of Fort Pierce matters at a reduced government rate.

RECOMMENDATION:

      Approval of a Contractual Agreement with Bell & Roper, P.A. for prior services and approval of two (2) separate Contractual Agreements with Olds and Stephens, P.A., for representation in related employment arbitration cases for Holmes and MacNaught v. City of Fort Pierce.

ALTERNATIVES:

     Deny approval of Contractual Agreements with Bell & Roper, P.A. and Olds and Stephens, P.A.
