1635 Thumb Point Drive - Demolition Hearing

SUBJECT:

Resolution No. 18-R31 and Quasi-Judicial Hearing - A hearing to allow the owners and/or parties of interest in the property identified as 1635 Thumb Point Drive to show cause why the structure located on the premises should not be condemned and demolished.

SUMMARY:

  1. The structure located at 1635 Thumb Point Drive was damaged during the twin hurricanes in 2004.
  2. June 2005, the structure was condemned by Building Official John Alcorn.
  3. March 2009, due to no action by the owner, a 2nd condemnation order was signed by Building Official Marc Meyers.
  4. April 2009, a permit to rehabilitate the structure was submitted to the City. It expired without the work being completed.
  5. April 2010, a permit to rehabilitate the structure was submitted to the City. It also expired without the work being completed.
  6. February 2014, the structure damaged in the 2004 hurricanes was demolished.
  7. March 2014, a permit to rehabilitate the structure was submitted to the City. This permit remains active today and will not expire until July 2018.
  8. July 2015, a petition signed by forty-five (45) neighbors was submitted to the City.
  9. February 2016, the City and Mr. Culverhouse signed an agreement with an action plan for the completion of the project with the stipulation that failure to comply with the timeframe would result in the revocation of the permit, the condemnation of the structure and the demolition of all the structural elements.
  10. January 2018, condemnation procedures were initiated against the property due to the continued nuisance conditions that have existed and the multiple complaints recieved from the neighbors.
  11. April 2018, at the request of Mr. Culverhouse, the nuisance condition was appealed and heard before Special Magistrate Ross. Special Magistrate Ross determined the property was a nuisance and forwarded the matter to the City Commission for a final determination.

RECOMMENDATION:

Staff recommend the City Commission approve Resolution No. 18-R31 declaring that the structure located at 1635 Thumb Point Drive is a nuisance and should be condemned and demolished in accordance with the Rules of Procedure for Condemnation and Demolitionl

ALTERNATIVES:

Amend Resolution No 18-R31 by condemning the property and ordering its rehabiliation by a date certain.
Deny Resolution No. 18-R31

Fiscal Impact

OTHER INFORMATION:

The cost of demolition, if required to be completed by the City, wil be funded by the Clean & Safe Initiative and shall become a lien against the property.
