BACKGROUND

Mr. Santil had entered a written contract (attached) in June of 2017 with Mr. Exume to renovate the property.  Although the majority of the contract amount had been paid, the work was never completed.

TIMELINE

June 29, 2017
June 29, 2017 Re-roofing permit was applied for.
June 29, 2017 Residential repair permit applied for windows, doors, and re-stucco of house.
December 11, 2017 Dry-in inspection and in progress inspection approved.  No final inspection as of this date.
June 29, 2018 Final inspection for residential repair permit approved.
February 26, 2019 Building Department receives Contractor Complaint against Mr. Exume.
February 28, 2019 Notice of Complaint is sent to Mr. Exume and Complainant.
March 18, 2019 Notice of Hearing is sent to Mr. Exume and Complainant.

ALLEGATIONS

Per the Alleged Charges form, Mr. Santil feels the contractor was negligent in his duties, that he abandoned the project before it was completed; disregarded applicable laws; and did not provide sufficient supervision.

ALLEGED CHARGES:

5-52(3) Committing incompetency or misconduct in the practice of contracting.
(5) Abandoning a construction project in which the contractor is engage or under contract as a contractor (A project may be  presumed abandoned after ninety days if the contractor terminate the project without just cause or without proper notification to the owner, including the 90 days).
(8) Knowingly or  deliberately disregarding or violating any applicable building code or laws of the state, county or city
(11) Failing to actively supervise construction projects for which the contractor has applied for and obtained a building permit; or for project for which the contractor is, by contract, responsible.
(14) Being convicted or found guilty, regardless of adjudication, or a crime in any jurisdiction which directly relates to the practice of contracting or the ability to practice contracting.

RECOMMENDATION:

To be determined at hearing.
