SUBJECT:

Reduce Code Enforcement Lien in the amount of $27,200.00 against 656 (Approx.) N 2nd Street, Ft. Pierce, FL owned by the Estate of Dennis J. Horvath, to $2,720.00, contingent upon payment within 60 days.

SUMMARY:

Request by Janet J. Power, personal representative of the Estate of Dennis J. Horvath and David N. Sowerby, Esq. legal counsel, 2940 S 25th Street, Ft. Pierce, FL 34981 to waive all costs totaling $27,200.00 leaving a balance of $.00.  The Special Magistrate recommends the Commission  reduce the fines to $2,720.00 which both parties have agreed to and is payable in 60 days.

RECOMMENDATION:

This recommendation is based upon:

1.  The millings were removed which complied the violation.
2.  Mr. Horvath is deceased and the Estate is wanting to satisfy the lien.

ALTERNATIVES:

1.  Deny the request.
2.  Determine an alternate amount.
