VIOLATIONS:

Section: 22-187 (13)                                               Landscape Maintenance
Property owners shall maintain all required landscaping so that it continues to present a healthy, neat and orderly appearance free from refuse and debris.  Required vegetation shall be replaced with equivalent vegetation if it is not living. Maintenance shall include sufficient weeding, watering, fertilizing, pruning, mowing, edging, mulching and other horticultural practices. 

FINDINGS/ORDER:

On March 2, 2011 the Special Magistrate found the owner guilty and provided 15 days  to cut the lot.  Failure to comply would result in a fine of $100.00 per day.

ACTION DATES:

1. March 29, 2011   - Property not in compliance; the fines began.
2. May 19, 2011      - Order Assessing Fine and Imposing Lien recorded.
3. October 31, 2012 - Violation corrected / Property in compliance / Fines stopped.
4. November 19, 2014 - Request for Partial Release of Lien reference 507 Hampton Place

A lien in the amount of $58,200 at this location is spreading to another property, 507 S. 5th Street, which is also owned by Phillip Brutus. A request has been received from Deutsche Bank NA, which is now the owner of 507 S. 5th Street, to release their property from the spreading lien so that it can be transferred to a new owner.

RECOMMENDATION:

Lien amount $58,240.00.
Grant partial release of lien, upon payment of $1500, to release 507 Hampton Place from the spreading lien attached to 1414 Avenue J and Mr. Phillip J. Brutus.
