SUBJECT:
Legislative Hearing - Ordinance 23-014 Amending Chapter 36 - Utilities, Article VIII imposing year-round Irrigation Conservation Measures. SECOND READING
SUMMARY:
- Chapter 373, Florida Statutes, grants the South Florida Water Management District the authority to regulate the consumptive use of water.
- Chapter 40E-2, Florida Administrative Code, regulates the use and consumption of water for the use of irrigation.
- Chapter 40E-24 calls for year-round and permanent landscape irrigation restrictions.
- The proposed ordinance includes:
- Restricting irrigation to two (2) days per week in general.
- Provides for variances and exceptions to the rule.
- Provides for enforcement and penalties of the rule.
- The proposed ordinance will take effect November 1, 2023 to allow nine (9) months to educate the public on the new rules.
RECOMMENDATION:
Approve the ordinance as presented.

Amend the ordinance.
