SUBJECT:
Legislative Hearing - Ordinance 23-017 - Review and approval of an Abandonment of Right-of-way, by applicant, Collins Brown Barket, to abandon right-of-way near the southeast corner of Seaway Drive and Carlton Court; abutting the parcel located at 1100 Colonnades Drive to the south. SECOND READING
SUMMARY:
- In accordance with City Code Sections 32-2: Abandonment, the applicant is requesting that the City of Fort Pierce abandon an unopened southern portion of Carlton Court between Seaway Drive and Alhambra Street which abuts their land holdings.
- The segment of Carlton Court has been unimproved and has not been utilized for utility infrastructure. This right-of-way segment sought for abandonment offers minimal vehicular, pedestrian, or utility design advantage to the City of Fort Pierce, especially in its unimproved state.
- The applicant owns the properties adjacent to the south of the subject Carlton Court right-of-way. The underlying objective for the applicant is to provide additional space for a driveway connection. The applicant has provided utility location reports and has stated that there is no utility line along the southern border of the right-of-way. A very small portion of the right-of-way segment is being considered for abandonment (0.00275 acres), based upon Florida State Statutes Chapter 336. Florida State Statutes Chapter 336 mandates that an abandoned right-of-way be granted to adjacent property owners. The property owner requesting this Abandonment is the only owner adjacent to the requested right-of-way to be abandoned. The applicant has provided an appraisal value of the subject portion of Carlton Court right-of-way at $2,100.
- The Fort Pierce Utilities Authority (FPUA) has provided approval of the proposed abandonment. All other affected Departments have reviewed and approved the proposed Abandonment.
RECOMMENDATION:
The requested Application for an Abandonment meets the criteria as specified in Chapter 32 of the City Code of Ordinances and is consistent with the City’s Land Development Code and Comprehensive Plan, therefore Staff recommends APPROVAL to the City Commission with one (1) condition:
- Payment of the appraised value, $2,100, for the subject right-of-way.
