Fort Pierce Police Officer Montgomery read the facts of the case.  He said the vehicle was driven over the sidewalk onto the grass and parked behind the trees at the parking lot east entrance of S. Causeway and Chucks Seafood Restuarant.  There is a curb and Florida state law says they can't jump the curb to park the car.  

Mark Rodriguez was sworn in.  He said he was unloading his kids so they could go to the beach.  He was there five minutes and got a ticket.  He was on a dirt road behind the trees. Saw no sign saying no parking.

Officer Montgomery agreed there were no signs saying no parking but there were signs saying to park in designated areas only.  He said if an emergency vehicle needs to treat a victim he can't get through the dirt road due to the vehicles illegally parking in this area.

Code Compliance Manager Arraiz said she would send Staff out to take pictures of the parking lot signs and have them available for the next time they were needed.
 

After hearing the case, the Special Magistrate dismissed it.

Officer Alesi read the facts of the case and presented photos. This is the old JC Penney parking lot in back of 2nd Street Bistro and other shops.   He said there is a sign at each end of the 111 Building.

Laura Mott was sworn in.  She said she was new to the area and working at Orange Bloom.  She didn't see the signs and assumed it was a parking area.
 

The Special Magistrate denied the appeal and found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated plus the administrative charges of $10.00 and waived the $18.00 late fee for a total amount due of $60.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Beryl Muise was sworn in.  She said she did park there.  She works down town and at the hospital part time and she is a member of the Downtown Business Association.  She stays on the run all of the time and just forgot about the citation.  
 


The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated plus the administrative charges of $10.00 and waived the $18.00 late fee for a total amount due of $60.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Code Officer Alesi read the facts of the case and presented photos.  Code Officer Isaac Saucedo was sworn in as translator.

Jayde Alvarez was sworn in.  She said she didn't know you couldn't park in the opposite direction.  In Puerta Rica you can park anywhere.  She said she understands this now and won't do it again.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated plus the administrative charges of $10.00 and waived the $18.00 late fee for a total amount due of $60.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Code Compliance Manager Arraiz said the City adopted a new program to accept canned food for fines beginning October 21 through November 31. They would get a $2.00 credit for each can they brought in.
