Kevin Grant, Building Inspector presents the case. Permit is required for building, electric, mechanical and plumbing work being done without a permit. Case photos were moved into evidence and Inspector Grant describes the work taking place in the photos. An electrical permit was issued after the Stop Work Order was issued. The electrical inspection failed due to the fact that the work was covered and could not be properly inspected. There was no one present to represent the owner. Special Magistrate finds that the violation exists and provided 60 days to get the permit or a fine may accrue. Mr. Oriska appears after the case was considered. He claimed that he has permits. The Special Magistrate recommends speaking to the Building Department to straighten things out.

Inspector Paul Julin presents the case for expired permit for a pool demolition. The owner, Mr. Selkin, was present and states that he obtained a permit for demolishing the pool. He states that it is a big job and he is the only person doing the job, so it's hard for him to complete the work. Special Magistrate clarifies the length of demo permits, which is 60 days. The owner is seeking an extension of time, and submits photos of the current state of the demolition. A complainant, John Lindsey was present and said that this has been going on since 2017, he also submits photos. Mr. Selkin and Mr. Lindsay are neighbors. Mr. Coss clarifies that a renewal of a permit is for 60 days, and an extension is for 30 days. After the first renewal, all subsequent renewals would have to be approved by the Building Official. The Special Magistrate finds that a violation exists and provides 60 days to get the permit or fines may accrue.

Mr. Coss presents for the City, and describes what work has been completed, and what items remain outstanding. A neighboring tenant, Brian Katz provides a response and describes the issues that have created delays. Mr. Darren Offsink, managing partner was present and states that all the remaining items to comply are connected to Phase 2, which they have decided to abandon. He hopes to renegotiate the agreement with the City without Phase 2. Mr. Coss states that any site plan approval or Comprehensive Plan is approved by the City Commission. He recommends an extension of 45 days so that they can meet with the Building Official, City Engineer, Director of Planning and Zoning, Mr. Katsock, Mr. Offsink, and their legal counsel if desired, to see if staff can agree to what Mr. Offsink is proposing. If an agreement cannot be reached within 45 days, staff recommends restarting the fines and impose a lien. If an agreement is reached within the 45 days, and the owner and managing partner are moving toward the agreement to the best of their abilities, then staff can offer administrative extensions. The Special Magistrate orders a 45 day extension to have the necessary meetings with the City. This matter will be continued to the December hearing.
