Inspector Paul Julin starts to present the citation case.  The cited violation is unlicensed contractor. An interpreter is required for a 3rd party that will be testifying. Ms. Brizuela, the interpreter, Katherine Calderon, and the 3rd party, Mr. Reyes are sworn in. Mr. Coss continues the presentation of the citation case. A complaint was received by Mr. Reyes.  He indicated that he hired Ms. Brizuela's company to install new windows and doors.  The building inspection did not pass so Mr. Reyes contacted the contractor 3 times, and they said they would come back out but did not.  Mr. Coss summarizes Ms. Brizuela's statement from the October Hearing, that she allowed a friend to use her discount at Home Depot to purchase the windows. Ms. Brizuela states that Antonio Dominguez is the person who purchased the windows and installed them.  Mr. Reyes states that he only dealt with Jose Brizuela, who was referred to him and took a $2500.00 deposit. He said that both men installed the windows. Mr. Reyes had to finish the installation since the other men never returned.

Mr. Coss presents case for the City.  He describes that a plumbing permit was obtained by a plumbing contractor who did not do the original work and found that the work done was not to code and additional work would have to be done to meet current code.  The owner, Ms. Appolon was present and stated that there was a dispute with the plumbing contractor over fees to do the work.  She wants time to hire another plumber to get the work done.  The Special Magistrate does a Review & Determination for the permit required item.  The Special Magistrate provides 60 days to get a permit or correct the violation or a fee may accrue.

A permit has been obtained for the AC & refrigeration and that item is under Review and Determination.  The other item regarding requiring a permit for the hood, the Special Magistrate provides 60 days to get the permit or a fine may accrue.

Mr. Coss presents for the City.  A permit is required for Change of Use of the property.  A meeting with Building Department staff, the property owner, and St Lucie County Fire District occurred previously where the parties agreed to provide owner with 90 days to obtain the necessary permit, to include a Fire Watch.  The Special Magistrate provides 90 days to get the permit, and a Fire Watch be maintained,  or a fine may accrue.
