FPPD Officer Sobon presented the case stating she parked in a handicap spot with no placqard showing.  He provided photos marked as Exhibit 1.

Maybell Webb was sworn in.  She said she has lived at this address for 6 months and other people were parking there.  She is disabled, has filled out an application to get a handicap permit but doesn't have the funds to pay for it yet.
 

After hearing testimony from Officer Sobon and the violator, Maybell Webb Special Magistrate dismissed the case.

Code Enforcement Officer Alesi read the facts of the case and presented photos.  

Miranda Feldman came to the stand.  She is a local attorney and said this was her daughter's car.  She is handicapped but didn't have the placqard showing.   
 

The Special Magistrate dismissed the case contingent upon her producing the handicap placqard.

Code Officer Alesi read the facts of the case and presented photos.

Carter Ullman was sworn in.  He also presented photos of the parking map and believed he was outside of the 2 hour limit zone.  In comparing the photos, Staff concluded the map on city website is wrong.
 

After hearing testimony from Staff and Mr. Ullman the Special Magistrate dismissed the case.

Code Officer Alesi read the facts of the case and presented photos.  He said the space was being used as a loading zone.

Sonny Booker, President of Bluebird Educational Foundation and Brian Welling, the event co-ordinator were sworn in.  Mr. Welling said this was an event permitted by the city.  The band was loading their equipment into the elevator.  He said they had the entire parking garage for the event.  It took about an hour to unload the band equipment and set up.  It was raining and they considered cancelling the event, but they moved off of the roof top to another floor.  They had been doing this for the last five years with no violation.

Officer Alesi said he saw no one going up and down the elevator.  Code Officer Debevec also testified that Officer Alesi left at 2:30 and she observed the vehicle still in the same spot at 5:00 pm.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $250.00 as indicated. She waived the administrative charges of $10.00 and the $18.00 late fee for a total amount due of $250.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Animal Control Officer Gasparre read the facts of the case  She said the dogs were still tethered to the dog house and the violator hasn't done anything to correct the violations.  

Deborah Ryals was sworn in.  She said she had no funds to purchase a kennel.  She hasn't talked to Officer Gasparre but Kevin has.  She said they have no funds for a dog.  Officer Gasparre mentioned that United for Animals would able to help them out.  She then said she has no transporatation.

Jannice Douglas and Susan Parry of United for Animals were sworn in.  Susan explained how they could help get the dog taken care of.  

Code Compliance Manager Arraiz said the City has amended their ordinance and you don't need a permit for doing an enclosed area anymore.  She asked if they could continue this case.
 

After hearing testimony the Special Magistrate continued this case for 45 days and scheduled the hearing for March 20.

Officer Gasparre read the facts of the case.  The dog was running at large and he has been hit by a car before.  She thought the dog, Rocco, belonged to Miss Agness.  When she approached she was told the dog belonged to Tykeyah.  

Tykeyah Marshall was sworn in.  She said she works from 9 to 6 Monday thru Friday and has no time to take the dog to the vet.  Officer Gasparre told her she could take him to Pet Vet on Saturdays for rabies and then get him registered through the city.  She had to either keep the dog in the house or provide a kennel. 
 

After hearing testimony, the Special Magistrate continued the case for 45 days.

Officer Gasparre read the facts of the case.  She said the original complaint was that the dogs were running loose.  They did fix the fence where the dogs were getting out from.  They need to get the dogs rabies and registration.  She said two small dogs are missing.

Zulma Rosario was sworn in.  She said the rabies were completed but she had not registered them yet.  
 

The Special Magistrate gave them 10 days to get the dogs registered, otherwise, they will be required to appear for the March 6 hearing date to receive further findings.

Code Officer Debevec read the facts of the case.  She said the Ms. Strong was working with Habitat for Humanity but she is now deceased.  Her daughter, Lily, continued working with them but she got in an accident. The contact information was given to the son, Harry, but he has done nothing to make contact or correct the violations.
 

Special Magistrate found that IPMC 304.2 and Section(s) 16-46, 16-47, 16-48 (11) are in compliance. She further found that a violation does exist for IPMC 304.7 and that Merdis Strong has committed or is responsible for the violations. She ordered that the violator has 30 days in which to apply for the permit and comply with all conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $50.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Code Compliance Manager Arraiz read the facts of the case. Mr. Hogan was appealing the fines due to not having notice of the hearing date.

David Hogan was sworn in.  He had been away with the USAF but he has updated his address now. He received no notice of the violations and knew nothing about the ordinance.  He said the ad was old and he has not rented for over two years.  

Staff confirmed this information and recommended deleting all fines.
 

After hearing testimony from Staff and Mr. Hogan's testimony and service to our country, the Special Magistrate rescinded the fines.

Code Compliance Manager Arraiz read the facts of the case.  She also reviewed the 7 criteria.  She said Staff would accept the proposed offer of $2,043.00 to settle the lien but if they would go to $3,000.00 they would not have to go before the City Commission for a lesser approval.  She would give them 6 months to make payment.

Al Harris was sworn in.  He said they were under contract for $4,000.00 and the property was going through probate.  He said they would like to get it at a lower price, but he would agree to the $3,000.00 reduction.  He said their intent was to rehab the property and rent or sell it.
 

The Special Magistrate reviewed the 7 criteria required by Rule 17 and as provided by Rule 17 approved the reduction of lien in the amount of $20,430.00 to $3,000.00 payable in 60 days. If not paid within that time the lien would revert back to its original amount.

This is a telephone conference call.  Alarm Co-ordinator Ricker read the facts of the case.  She said Ms. Shelly paid $60.00 leaving a balance due of $240.00.

Delores Shelly was sworn in.  She said she wasn't home for the first 2 alarms.  When she got notice she told the alarm company to shut the alarm off.  She got a 3rd notice and this was a silent alarm. She said she didn't know anything about a silent alarm. She called about this and she was told she would have to register the alarm.  Again, nothing she knew anything about.  The alarm company finally sent someone out to check the system and this time they set off the alarm.  She demanded the company shut off the alarm.  Now, they said it was her system.  She undid the equipment and returned to Comcast.  She no longer has an alarm system.
 

The Special Magistrate, after listening two the testimony of Staff and Ms. Shelly, reduced the fines to $40.00 to cover administrative fees payable in 30 days. The order will be forwarded to Cry Wolf for processing.

Code Officer Debevec read the facts of the case.  She said the property owner has received several extensions and has heard nothing from him since the December extension.  Nothing else has been done on the property..
 

The Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated October 3, 2018 be and the same is hereby granted to the extent specified in this Order.

In the event the violations specified in said Order Determining Violation dated October 3, 2018 are not remedied within 20 days, there shall be imposed a fine at a daily, cumulative rate of $50.00.
