The Special Magistrate finds that a violation does exist and that Rocio Summers having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. Through questioning by Assistant City Attorney Earley, Officer Saucedo confirmed that he initiated Case # 19-1073 on April 25, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.  The Special Magistrate admitted them as composite Exhibit 1.  There was no respondent present to object to the violations.
 
 

The Special Magistrate found that a violation does exist and that Joyzell M. Friason having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. It is hereby ordered that the Violator be given the number of days recommended by the Code Enforcement Officer on the case summary sheet to come into compliance or they will be fined the amount also shown on the summary sheet. The Violator shall have 30 days within which to appeal this decision to the Circuit Court.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-1415 on June 5, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.  The Special Magistrate admitted them as composite Exhibit 1. 

Officer Debevec said this case was continued from July 21 and it was an appeal.  She said commercial vehicles are not allowed on residential properties.  One of the trucks and a trailer is considered farm vehicles and there are 2 box trucks with no tags. 

Rufus Filmore was sworn in for testimony.  He said the vehicles in question do have tags now and there are two trucks and a trailer that don't have tags yet.  
 

Special Magistrate denied the appeal and found that the violation(s) listed on the summary sheet do exist and Rufus Filmore Sr. has committed or is responsible for the violation(s). He ordered that he has until August 20, 2019 to obtain tags for the vehicles. In the event the tags are not obtained, City will order the vehicles be towed and the charges assessed to the owner.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violation.  Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-1076 on May 1, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   The Special Magistrate admitted them as composite Exhibit 1.

Officer Debevec said the fence has been removed but the barbed wire is still there.  

Ezekiel Ryan Jr., a pastor of the church, affirmed that he would tell the truth.  He said the barbed wire fence had been there since the 1980's and he felt he should be grandfathered in.  He said the facia had to be treated for termites and he was working on it. They have had several things come up and didn't have the finances to fix it.

Code Compliance Manager Arraiz said Staff was withdrawing the barbed wire as it is cited under an incorrect statute.  It is not grandfathered but it is the wrong violation section.
 

Special Magistrate found that the violation for the IPMC 304.2 listed on the summary sheet does exist and that Apostolic Church of Jesus Inc. has committed or is responsible for the violation. He ordered that the violator(s) has until September 6 to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time given, a fine of $50.00 per day will be assessed for each day the violation(s) continue past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Officer Debevec said they have been working on correcting the violations.  The barbed wire fence case is being pulled as it is a part of the previous case and the code was incorrectly cited.

Ezekiel Ryan Jr. testified that they were in the process of repairing and pressure washing the building but needed more time.
 

Special Magistrate found that the violation(s) IPMC 304.2 listed on the summary sheet does exist and Apostolic Church of Jesus Inc. has committed or is responsible for the violation(s). He ordered that the violator(s) has until September 6 to comply with the City Code of Ordinances. Officer Debevec stated she has been working with Ms. Ventresco.  Some of the items have been removed; however, there is still a crate and other items that the next door neighbor is thought to be putting on her property.

Sallie Ventresco was sworn in.  She said the person of interest rents the house, he is in poor health, she has his telephone number but has not been able to talk to him.  She doesn't see him doing anything about moving the stuff.  She doesn't know why he is parking his vehicles on her property.  

Code Compliance Manager Arraiz said the City could go in and tow the vehicles if Ms. Ventresco gave them authorization to go on her property.  

As far as the other violations, Staff recommended continuing the case until next meeting, September 4.
 

The Special Magistrate continued this case until the September 4 hearing.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violationThrough questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-1133 on May 8, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.

Curtis Randolph, Sr. was sworn. He said the tenant was supposed to take care of the violations but didn't.  He asked for more time to take care of it.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-1633 on June 27, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.
 
Code Compliance Manager Arraiz explained the Cepted that was adopted by the City Commission.  She said this case was previously dismissed because the laws did not support the violation.  It is now cited as a nuisance.

Garnett Bowe was sworn in.  He said this grass patch was there as a shrine for his father.  He said he would cut the grass. He did not want to put up the fence.

 

Special Magistrate denied the appeal and found that the violation(s) listed on the summary sheet does exist and that Garnett Bowe has committed or is responsible for the violation(s). He ordered that the violator(s) has until August 19 to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time given, the City will be ordered to mow this section in accordance with the provision outlined in Chapter 16 of the Code of Ordinance.

Code Compliance Manager Arraiz read the facts of the case and reviewed the 3 criteria necessary for approving reduction of a case with fines.  There is no lien at this time.  Although the notice is sent to the address listed with the county property appraiser we did notify Mr. Benmoshe who is one of the owners.  His address is in California and he was advised to update the address with the county.  Once he learned of the violations he had them taken  care of and requested the reduction. 

Yarron Benmoshe was sworn in.  He said his tenant did not inform him of the letter.  
 

Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $8,080.00 to $600.00 payable by September 6. If not paid within this time, the fines would revert to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court's Office.
